Husband in Nagpur and wife in America; Court grants divorce by video-conferencing on whatsapp call

A Family Court in Nagpur (Maharashtra) adopted an unusual method for the judicial process of grant of divorce. The court accepted and adopted the method of allowing the woman who was living in the US to appear on a Whatsapp video call beamed into the courtroom where the estranged husband appeared in person, seeking a divorce on mutual consent.

The wife, 35, is studying in Michigan, US, on a student visa. Expressing her inability to attend the hearing as she was not permitted to seek long leave from her educational institution, the woman had requested that the hearing be conducted via a WhatsApp video call. The husband, 37, a resident of Khamla in Nagpur, works in Michigan, but was in his home town when the divorce was officially granted by mutual consent.

The couple, originally from Nagpur, lived in Michigan in the US since 2013. Since 2017, a dispute has been cropped up between the husband and wife. The two then began living separately in America. In the meantime, the husband returned to India and filed his divorce application in the Family Court of Nagpur.
