Supreme court allows IT dept to reopen tax assessement of Rahul and Sonia in National Heralds Case

New Delhi: The Supreme Court on Tuesday allowed the income-tax department to reopen the tax assessment of top Congress leaders Rahul and Sonia Gandhi for 2011-12 in connection with the National Herald case.The court also said it was not expressing any opinion on the merits of the pleas filed by Rahul and Sonia Gandhi in the caseA bench headed by Justice AK Sikri issued the restraining order against the I-T department and fixed the matter for hearing on January 8.

The bench made it clear that the validity of assessment will be subjected to final verdict of the apex court.Rahul, Sonia Gandhi and veteran Congress leader Oscar Fernandes had challenged the September 10 verdict of the Delhi High Court after they failed to get any relief from the High Court.

High Court had dismissed their challenge on reopening of their tax assessments for 2011-12.Solicitor General Tushar Mehta, appearing for the I-T department, said the court should not restrain it from implementing the assessment orders against the Gandhis and others.He said the court should hear the matter and pass appropriate orders.
