New Delhi : The supreme court today stayed the judgment of kerala high court which had disqualified MLA KM Shaji. The division bench comprising of Justice AK Sikri granted the stay on an appeal filed by Shaji at the apex court.
The supreme court while allowing Shaji to continue as an MLA, said that he can neither take part in voting in the assembly nor enjoy the benefits of a legislator. Shaji will be able to attend the assembly proceedings, which will commence from tomorrow.
The High Court had delivered the judgement on a plea filed by LDF candidate M V Nikesh Kumar, who contested the election against Shaji. Highcourt then diqualified KM Shaji after finding that he instigated communal polarization during the election campaign for 6 years.
Senior Advocate Kapil Sibal appeared for Shaji whereas senior Advocate V Giri appeared for Nikesh Kumar.
